Converting commercial property to residential use is increasingly popular across the UK. However, the planning process for change of use can be complex.
What Is Change of Use?
A change of use occurs when a building is used for a different purpose than its current planning classification. The UK uses classes including:
- Class C3: Dwellinghouses
- Class C4: Houses in Multiple Occupation (HMOs)
- Class E: Commercial, business, and service uses
- Sui Generis: Uses that do not fall into any class
Permitted Development for Change of Use
Converting Class E (commercial) to Class C3 (residential) can be done under Permitted Development rights via Class MA of the GPDO, subject to conditions:
- Building in commercial use for at least 2 continuous years
- Vacant for at least 3 continuous months
- Maximum floor space of 1,500 square metres
- Prior Approval required from the council
Prior Approval vs Full Planning
Prior Approval is a lighter process where the council assesses specific impacts including transport, contamination, flooding, noise, and natural light. The council must decide within 56 days.
When Full Planning Is Needed
Full planning permission is needed when the change does not qualify for Permitted Development, the building is listed, external alterations are proposed, or the floor space exceeds PD limits.
HMO Conversions
Converting to an HMO for more than 6 occupants requires planning permission and an HMO licence. Many London boroughs also require permission for smaller HMOs through Article 4 directions.
